Ok sooo I got my shifting stone right next to an enemy model

is it in melee or not?

I mean it cannot engage because its immobile

but when I go to attack it with a ranged attack do I suffer the -4 for being in melee?

is the enemy model engaging it with their melee? if so, yes.

A model is 'in melee' when it is either engaging another model or being engaged by another model. The former is impossible in this case since the stone has no melee range. The latter, however, is possible. If an enemy model has the stone in its LOS and melee range, the stone is engaged by that model and is therefore in melee. A ranged attack against it would get the -4 penalty in that case.

The enemy is not engaged by the stone, but the stone is engaged by the enemy so they are both in melee
